Tractor-Trailer Collision Leads to $1.05 Million Settlement
A tractor-trailer ran a red light at the intersection of S.C. Highway 9 and Oakwood Street in Bennettsville on August 26, 2020, resulting in a T-bone collision with the plaintiff. Initially, the truck driver told a story that contradicted an eyewitness report. When a plain-clothes officer arrived on the scene, the truck driver stated that he “tried to beat the light.”
The tractor-trailer had a dashcam, but the trucking company misplaced the SD card containing the footage from the collision. Despite the plaintiff’s counsel’s early demands to preserve the video, they were unable to retrieve it. Cellphone records obtained via subpoena revealed that the truck driver was most likely talking on his phone at the time of the collision.
The case was settled in May 2023 for $1,050,000 after several months of mediation.
